The South Florida team agreed they “misled/failed” me on Zoom meeting. Five years of drama , lies, 4 more surgeries to repair the mess. Loss of spleen, kidney , adrenal gland and 1/2 pancreas. Lots more crazy stuff.

everynicknameis taken20182019Excellent podcastWould love an episode dealing with the phenomenon of the always present possibility of a jury verdict above the malpractice coverage amount and how that possibility might disincentivize a defendant from defending an otherwise defensible case choosing instead to settle with the insurance company’s money rather than take the tiny risk of losing personal assets. I think this fear inducing phenomenon could be an under recognized perversion of the system wrongly withholding many otherwise readily defensible cases from the scrutiny of an impartial jury and resulting in potentially inappropriate settlements. In some ways this is very analogous to the plea bargain problem in criminal justice where innocent people plead to a lesser charge rather than face the inherent unpredictability of a jury trial. Great podcast. Very well done.
